1.0 Your relationship with VMHaus Limited

These Terms ("Terms", "Terms of Service") govern your relationship with https://www.vmhaus.com (the "Service") operated by VMHaus Limited ("us", "we", or "our").

Please read these Terms of Service carefully before using the Service.

Your access to and use of the Service is based on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms and accept all legal consequences. If you do not agree to these terms and conditions, in whole or in part, please do not use the Service.

1.1 Purchases

  a) If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

  b) You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

  c) By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

1.2 Links to Other Websites

  a) The Service may contain links to third-party web sites or services that are not owned or controlled by VMHaus Limited.

  b) VMHaus Limited has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that VMHaus Limited shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

1.3 Termination

  a) We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.

  b) All provisions of the Terms shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

  c) Upon termination, your right to use the Service will immediately cease.

1.4 Governing Law

  a) These Terms shall be governed by, and interpreted and enforced in accordance with, the laws in the United Kingdom, as applicable.

  b) If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, then any remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements, oral or otherwise, regarding the Service.

1.5 Anti Spam

  a) When deploying a server, you agree that you will not send unsolicited email. We define unsolicited email by communications of which the recipient has not agreed or consented to receiving.

  b) You also agree that when sending email, you follow the appropriate regulations (The Privacy and Electronic Communications Regulations of 2003).

1.6 Acceptable Content

   a) By signing up and deploying a server, you may not:

       - store/serve child pornography,

       - send unsolicited email,

       - abuse and/or cause issues with neighbouring servers,

       - send DDoS (Denial of Service) attacks,

       - operating public proxies or VPNs, this includes the sale of VPNs on our network,

       - store/serve "Warez," "nulled," or any other illegal software,

       - store/serve intellectual property or content that belongs to another party,

       - perform any other activity deemed illegal in the United Kingdom and/or the provisoned area of your server.

   b) When deploying a server, you agree to not cause any harm to other parties and to our hardware. Doing so will lead to immediate termination upon discovery and notification to the appropriate authorities should we deem it necessary.

1.7 Liability from Hardware Failure

   a) By using our "Service(s)," you agree to not hold VMHaus Limited liable for any damages as a result of a natural disaster, or any extenuating circumstances that may lead to hardware failure.

   b) You understand and acknowledge that backups are not guaranteed and will only be provided if available.

1.8 Refunds

   a) We reserve the right to refuse refunds if we suspect and/or discover abuse of the guarantee.

   b) When deploying a server, you also agree that refunds will only be provided as a courtesy within a seven (7) day period, this does not apply to AliPay or Bitcoin payments. Only PayPal are eligble for 7 day money back at this time.

1.9 Circumvention of Abuse Prevention Measures

   a) When signing up, you agree and accept that only one (1) account is permitted.

   b) You also agree that you will not create multiple accounts in order to circumvent/bypass restrictions placed on any previous account.

2.0 Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.

2.1 Objections and Contact Information

3.0 Resource abuse

We reserve the right, at our sole discretion, to determine and classify whether the actions on your server are considered abusive to our platform.

Shared or fair share cores means that you do not have the CPU cores dedicated to you at all time, you are permitted to burst their capacity for up to 15 minutes at a time, any long may be subject to throttling or suspension until an appropriate resolution can be put in place. Disk IO is also a shared resource, we do not permit long heavy, sustained periods of disk operations to be used, this includes both IOPS and write/read bandwidth. Your disk space is fully dedicated and is not shared among others. Bandwidth is dedicated to you, despite this the port speed is not dedicated and we do not permit sustained high bandwidth use from your VPS without prior consent from our team.
